European Companies (SE) and Cooperative Societies (SCE) provide for workers’ involvement at transnational level. The SE Directive (Directive 2001/86/EC) linked to the SE statute (Regulation EC 2157/2001) has, for the first time, introduced participation rights for workers at board level. Negotiations must take place to establish information and consultation procedures through the establishment of an SE works council. The ETUC demands a European minimum standard that goes beyond the “before and after principle” (whereby board-level representation is only guaranteed if it already exists beforehand at national level) enshrined in the SE Directive, and calls for a directive introducing a new and integrated architecture for workers’ involvement in European company forms.
